TNAFlixx Terms of Service and User Agreement

By accessing or using the TNAFlixx website, mobile application, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. Your use of the Service is also governed by our Privacy Policy, which is incorporated herein by reference.

TNAFlixx ("we," "us," or "our") operates an online platform designed for adults (18 years or older, or the age of majority in your jurisdiction) to connect, share content, and engage in social interactions within a secure environment.

The Service and its original content, features, and functionality are and will remain the exclusive property of TNAFlixx and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of TNAFlixx.

User Content: By posting, displaying, or otherwise providing any content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods.

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to grant the license above and that your content does not violate any third-party rights.

To the maximum extent permitted by applicable law, in no event shall TNAFlixx, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use, or alteration of your transmissions or content,

whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the greater of one hundred US dollars (USD $100) or the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

TNAFlixx, its subsidiaries, affiliates, and its licensors do not warrant that:

• The Service will function uninterrupted, secure, or available at any particular time or location;
• Any errors or defects will be corrected;
• The Service is free of viruses or other harmful components; or
• The results of using the Service will meet your requirements.

Some jurisdictions do not allow the exclusion of certain warranties, so the above exclusions may not apply to you.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Delaware, before one arbitrator. The arbitration shall be administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules.

Notwithstanding the above, we may seek injunctive or other equitable relief to protect our intellectual property rights in any court of competent jurisdiction.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.
